Agreement For Peace And A New Constitution
This policy letter contains evidence and recommendations on the timing, sequencing and inclusion of non-dedication armed groups and civil society actors in peace processes. The aim is to provide a strategic understanding of how to design and implement peace processes that effectively lead to inclusive political, economic and social change. The document aims to fill the gap in the constituent and peace-building literature with regard to descriptive and normative reports on the relationship between peace agreements and constitutional agreements in political colonization processes. It examines the succession of peace agreements and constitutional agreements in order to better understand when (and why) sequencing does not follow the logical model and what the consequences are on a coherent and practical constitutional framework. This report is a first study of these issues, which should contain initial recommendations and prompt further reflection. To do so, it relies on work at a workshop in December 2015 entitled “Building the Constitution in The Processes of Political Colonization: The Search for Inclusion” (International IDEA 2016). We see that sovereignty, which is part of the definition of a constituent assembly, is made impossible by the Piaera Agreement, which sets out a number of constraints to adapt the process to the size of the veto power that the right wing has historically enjoyed, thanks to the constitutional ties that made the 1980 Constitution famous around the world. Finally, and not least, the concrete means of achieving the announced social peace are not mentioned – only the criminalization programme is in place. The agreement avoids a demand at the centre of the movement since the 19 October curfew, namely reparations for the many human rights violations that took place during the conflict. In concrete terms, the aim is to create a commission on truth, justice and reparation that guarantees impartiality, after more than 2,300 injured (222 of them lost one of the two eyes), nearly 7,000 people arrested (10% of them children) and 22 deaths, as official reports say. 5. The only objective of the elected constituent body is to draft the new Constitution and will be dissolved once this task is completed. The search for integration paths for peace has become, in recent years, one of the cornerstones of the international peace-building agenda. While there is growing consensus that the inclusion of different constituencies and interests in conflict resolution processes is a determining factor in the establishment of lasting peace, there remains great confusion and differences of opinion as to the timing and succession of the integration of several factors into the organization of the peace process in order to find legitimate, just and lasting solutions to complex long-term armed conflicts. This report contributes to this debate by conducting a comparative assessment of “incremental integration” approaches for armed groups and non-signatory civil society actors during the negotiation and implementation of four peace/ceasefire agreements.
