This policy letter contains evidence and recommendations on the timing, sequencing and inclusion of non-dedication armed groups and civil society actors in peace processes. The aim is to provide a strategic understanding of how to design and implement peace processes that effectively lead to inclusive political, economic and social change. The document aims to fill the gap in the constituent and peace-building literature with regard to descriptive and normative reports on the relationship between peace agreements and constitutional agreements in political colonization processes. It examines the succession of peace agreements and constitutional agreements in order to better understand when (and why) sequencing does not follow the logical model and what the consequences are on a coherent and practical constitutional framework. This report is a first study of these issues, which should contain initial recommendations and prompt further reflection. To do so, it relies on work at a workshop in December 2015 entitled “Building the Constitution in The Processes of Political Colonization: The Search for Inclusion” (International IDEA 2016). We see that sovereignty, which is part of the definition of a constituent assembly, is made impossible by the Piaera Agreement, which sets out a number of constraints to adapt the process to the size of the veto power that the right wing has historically enjoyed, thanks to the constitutional ties that made the 1980 Constitution famous around the world. Finally, and not least, the concrete means of achieving the announced social peace are not mentioned – only the criminalization programme is in place.
