The Ombudsman found that between 1 March 2016 and 10 October 2017, the public trustee had inappropriately failed to terminate a lease of an entity which the Office of the Public Advocate had found [X] could not return. As a result of the measures taken by the public agent,[X] had paid for both the lease and accommodation in nursing homes for a period of almost two years. The Ombudsman recommended that the public representative reimburse [X] the lease payments between 1 April 2016 and 10 October 2017. On April 30, 2018, the public agent [X] reimbursed a total of $9,601.68. September 2016: City of Victor Harbor – Violation of the Council Development Assessment Panel Code of Conduct The Ombudsman has investigated a complaint as to whether a member of the Council, in his capacity as a member of the Council`s Development Assessment Panel, breached the Code of Conduct issued by the Minister pursuant to Section 21A of the Development Act 1993. The Ombudsman found that the Council member had infringed clauses 2.4, 2.6, 2.8(c) and 2.10(a) of the Code of Conduct and had acted contrary to the law referred to in Article 25(1)(a) of the Ombudsman`s Law. The Ombudsman recommended that the Council member receive training on conflicts of interest and the code of conduct.
